Zina

Zina (Adultery) is an Arabic term that in Islamic law refers to sexual intercourse that is pre-marital or extra-marital in its occurrence; Because Zina (fornication) in its biological sense is sexual intercourse and according to the definition of Zina (fornication), penetration of a man's penis into a woman's vagina is required.  From the above statement, it is understood that the Arabic term zina includes both meanings;  First, Zina (fornication), which occurs before marriage or between unmarried persons, and second, adultery, which occurs with one's unmarried mate (man or woman). In both cases, it is adultery, but in the first case, the punishment for this sin is in the form of hundred lashes according to the Qur'an, and in the second case, the punishment for this sin is in the form of stoning according to the Hadiths. The punishment of stoning for extra-marital adultery is mentioned in the hadiths, but there is no mention of it in the Qur'an as a punishment for adultery, or we can even say that the existence of this punishment is not proven by the Qur'an;  Moreover, there must be at least four righteous and competent witnesses who can give evidence about the incident in detail; That is, these witnesses have seen the concerned persons committing adultery with their own eyes (and according to the definition of adultery, the insertion of a man's penis into a woman's vagina is required, as if the witness's seeing this insertion becomes a condition for witnessing the act) and If the testimony of any of them is found to be false, severe punishment is required on those witnesses themselves. There are controversial opinions on stoning even today in the Muslim world, while in the non-Muslim world, even by Muslim scholars, the punishment of stoning cannot be applied, and no individual is considered worthy of stoning.  The practice of stoning (stoning) is mentioned not only in Islam but also in ancient Greek, Jewish, and Christian documents.

Zina is the greatest sin after polytheism, and intense punishments are specified in Islam for its perpetrators. Witness Statements Muslim scholars offer different levels of views on the definition of adultery and in this sense, any act that involves sexual gratification is considered adultery; Among these actions, kissing, touching the opposite sex, having sex, and even looking at the opposite sex or being close to him with sexual thoughts are also considered adultery. According to the scholars, there are some zina for which no punishment is given (under normal circumstances), while the legal definition of Zina for which punishment is imposed is the same as that mentioned at the beginning of this article, i.e. the sexual intercourse between a woman and a married man. Penetration of organs, other types of adultery apart from this type of adultery, even if there is a punishment of obscenity or fornication, it is different according to its nature and not a punishment of a hundred lashes.


As cited at the start, four witnesses are required for the execution of the punishment for adultery, who have witnessed the act of fornication with their own eyes. The perpetrators of this act may admit it themselves. It is logically impossible under normal circumstances for four witnesses to observe two persons having sexual intercourse at the same time and their genitals penetrating each other, and there would probably be very few persons who would after the act had been committed. Confess it to yourself and submit yourself to be stoned. Now there remains one more case and that is when a woman becomes pregnant.  Then, if the testimony of any of these witnesses is found to be flawed, severe punishment is necessary for them.


It is forbidden for non-mahrams to communicate with each other without any necessity.  Be it in any case, be it through chat or message or call or face to face, in any case, it is not permissible.  Rather, it is forbidden. Chatting is not adultery, but it leads to adultery. That is why it is forbidden because today there will be a talk on the chat, then through the phone, there will be a meeting and it will conclude that fall into adultery due to this illicit relation.  So it is not adultery but something that leads to adultery.  And Islam has prohibited everything that leads to Zina. Therefore, all the described forms of communication and relationship with non-mahrams are illegal and haram. The Holy Prophet ï·º (Peace and Blessings of Allah be Upon Him) said that there is fornication with the eyes, similarly, there is fornication with the tongue, which is an obscenity and nonsense talk.


If there is physical interaction before marriage, it is adultery, even if they both marry later.  Founding such relations before marriage is adultery. After the marriage, the relationship between the two is halal and according to Shariat.  In this case, We should sincerely repent and seek forgiveness from Allah Almighty.


Verses and Hadiths About Zina in the Holy Quran

1) "And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way." (Surah Bani Israeel, 17:32)


2) "And those who do not invoke with Allah another deity or kill the soul which Allah has forbidden [to be killed], except by right, and do not commit unlawful sexual intercourse. And whoever should do that will meet a penalty." (Surah Al-Furqan, 25:68)


3) Abu Huraira reported The Prophet ï·º (peace be upon him) said,

Verily Allah has fixed the very portion of adultery which a man will indulge in, and which he of necessity must commit. The adultery of the eye is the lustful look, and the adultery of the tongue is the licentious speech, the heart desires and yearns, which the parts may or may not put into effect.  (Muslim # 6753)



4) Narrated Zaid bin Khalid: Allah's Apostle ordered that an unmarried man who committed illegal sexual intercourse be scourged one hundred lashes and sent into exile for one year. (Bukhari # 2649)
